Estate Planning

Your death or the death of a family member is a difficult issue to contemplate. Many people choose to ignore it while others feel that they do not have enough to worry about. However, planning is essential for a successful transfer of your accumulations of a lifetime, particularly if you wish to leave your property to individuals who would not ordinarily be entitled to a distribution from your estate.

It is also necessary to plan if you have minor children and want to have some control over where they will be raised and how your money will be spent after your death. This is where estate planning comes in. We can meet with you, examine your particular needs and determine which estate planning tools will provide you with the best plan based upon those needs. This plan may include some or all of the following:

  • Revocable Living Trusts
  • A Will
  • Durable Power of Attorney for Financial Management
  • Durable Power of Attorney for Health Care

Trust Administration

Depending upon the complexity of a decedent’s assets held in trust and their debts, an attorney may need to be consulted by the successor trustee of a trust. As the attorney, we represent the trustee to help him or her administer the trust efficiently and as required by law. Trust administration is not generally supervised by the Courts, but a trustee may request assistance from the Court when questions arise as to how best to handle any given situation. As the attorney for the trustee, we are paid on an hourly basis.
